One essential step leading to the safe use of chemicals is the identification of the specific hazards and the organisation of that information so that it can be conveyed to users of chemicals in a form that is easy to understand. Measures can then be taken to avoid or manage potential risks in circumstances where exposure may occur. This is the fundamental rationale behind the hazard classification and labelling of chemicals.
This document is created to give an overview about the classification and labelling (C & L) process within the European Union (EU) in general. Furthermore, the document gives an in depth overview for C & L of health effects like carcinogenicity, mutagenicity, reprotoxicity and sensitisation.
In the future the C & L labelling system, as described in Directive 67/548/EC and updated by Directive 2001/59/EC, will most probably be substituted by a Global Harmonised System (GHS). This report summarises the criteria for classification and labelling as described in Annex VI of Directive 2001/59/EC and gives an introduction to the Global Harmonised System (GHS). Additionally the substances in Annex I classified as carcinogens, mutagens, reprotoxicants or sensitisers are listed to give an overview for these endpoints.
2 The Classification and Labelling process
The objective of C & L is to identify:
When hazards are identified (classification), substances are labelled accordingly and the European citizen can be protected in the appropriate manner.
The C & L process starts with self-classification. Producers of chemical substances are obliged to carry out an investigation to make themselves aware of the relevant data that exist, concerning the properties of the substances they want to place on the market. New substances need to be adequately tested before they may be placed on the market. Data of existing substances may be obtained by results of previous tests, literature or practical experience. If necessary, there need to be performed additional tests to identify hazards. Results of the tests must be forwarded to the Member State Authority as soon as possible.
When a substance is considered as dangerous for health or environment by this authority, the Member State (MS) can act as rapporteur for the substance, and forwards the data to the other MS (via the European Chemicals Bureau).
2.2 Classification on a European level
Meetings between all MS are organised several times a year by the European Chemicals Bureau (ECB), in which the opinion of all MS is considered in a recommendation for the classification, based on the data that are available. As a guideline for the classification of substances, Annex VI of Directive 67/548 is used. In this Directive, criteria for the classification and labelling process are presented (See Chapter 3).
Suggestions for classification and labelling for physicochemical, eco-toxicological and toxicological hazards, are given by the European rapporteur MS to the ECB, who distributes the proposal to all Member States. Any MS, which has good reason to believe that a suggested classification and labelling is inappropriate, or wishes to support the proposal, shall notify the Commission thereof. During the meetings the position of each EU country is clarified by discussions about the data related to a substance under evaluation.
Only substances that have been sufficiently tested, and from which sufficient in vivo and/or in vitro data exist (that fulfil the criteria of Annex VI), can be classified and labelled. In case of a lack of data on a particular substance, also data of substances with similar molecular properties might be used. In some cases, when MS are not capable of making a recommendation, specialised experts should be consulted to give advice about the toxicological properties of the substance under evaluation.
During the meetings, the ECB takes note of the proposals and recommendations for classification and labelling of all substances discussed, and writes a summary. The result is a recommendation by the group for the C & L of the substance in question. Substances that may be toxic or cause harm to the environment or human health, should be placed on Annex I to directive 67/548, containing at present about 3000 substances.
The procedure to add substances to Annex I is as follows;
After control by the EU member states, the recommendations for classification are sent to the Directorate General (DG) for Environment in Brussels. The recommendations are accepted only after being approved by a Technical Progress Committee, composed of representatives of the member states (MS). After approval, the recommended classifications of the substances that were discussed, are then published in an official journal as an Adaptation to Technical Progress (ATP) of Directive 67/548. The contents of this official journal are then legally binding within the EU. The development of ATP 29 is currently (Autumn 2002) in progress.
Substances that are carcinogenic, mutagenic or reprotoxic (CMR) are placed into categories 1, 2 and 3. The CMR substance of categories 1 and 2 are falling under Directive 76/769, which is describing which substances should be banned from the European market.
2.3 The labelling of substances
When the hazard is identified (classification), the substance or preparation of a substance must be labelled to indicate the hazards in order to protect the producer, the user and the environment. The most severe hazards are highlighted by symbols. All hazards are specified in risk phrases, and safety phrases give advice on necessary precautions.
When preparations of a substance are made, concentration limits according to the preparations Directive 1999/45/EC have to be applied.
In general the label contains the following information;
Attention is paid to the clarity and impact of the label. The necessary information is expressed in a minimum number of phrases, although there should not be used more than six R- phrases for preparations, and never be more than six S-phrases.
For the labelling process there are some specific rules as well, which are further specified in Annex VI to Directive 67/548.
Statements indicating that the substance is not dangerous shall not appear on the label.
The symbols used to visualise the danger, shall be the ones used in Annex II of the Directive 67/548. They should appear on the label in black, on a yellow-orange background.
The wording of the R-phrases must be in compliance with that laid down in Annex III of directive 67/548. Also combined risk phrases are described there. The wording of the S-phrases and combined S-phrases shall comply with that laid down in Annex IV of directive 67/548. The R- or S-phrases corresponding to the category of danger must appear on the label.
3 Criteria for C & L as described in Directive 67/548
Directive 67/548/EC, as latest updated by Directive 2001/59/EC, describes how all substances present on the European market should be classified and labelled according to the European legislation. This Directive consists of eight different Annexes from which five form the basis for the classification and labeling system within the EU.
Annex I; Contains dangerous substances that have been classified and labelled, and is updated regularly. Substances in Annex I are coded by an Index Number containing the atomic number, the form in which the substance is produced or placed on the market, and a check-digit. The substances are also identified with EINECS-, ELINCS-, No-longer polymer- and CAS numbers when available and where appropriate. In Annex I, the EU harmonised C & L are given for the listed substances. Specific concentration limits in preparations are given for those substances from which it is scientifically proven that those would be different than the general concentration limits as given in the preparation Directive (1999/45/EC). At the moment (last Adaptation to Technical Progress was nr. 28), 2989 substances or groups of substances, corresponding to about 5000 individual substances, are included in Annex I.
Annex II; Contains symbols and indications of danger for dangerous substances and preparations.
Annex III; Contains descriptions of nature of special risks attributed to dangerous substances and preparations, the so-called risk phrases (Correspond to the hazardous statements in the GHS).
Annex IV; Contains safety advice concerning dangerous substances and preparations, the so-called safety phrases (Correspond to the precautionary statements in the GHS).
Annex VI; Contains the general classification and labeling requirements for dangerous substances and preparations.
3.2 Criteria for classification and labelling for health effects, according to Annex VI of Directive 67/548
Before a substance may be classified and labelled for health hazards, certain criteria have to be met. Such criteria are described in Annex VI of Directive 67/548. To achieve a good classification and labelling requires cooperation from manufacturers, distributors and importers of dangerous substances.
To obtain the data, tests that are described in Annex V of Directive 67/548 may be used. That Annex also describes that in vitro studies, that have been sufficiently validated, are accepted for some types of toxicity testing.
Substances may become classified as dangerous for the environment or health. In this report we only focus on the carcinogenic, mutagenic, reprotoxic and sensitising properties of substances.
carcinogenic, mutagenic, reprotoxic in category 1, 2 or 3.
Category 1 is used when the substance is known to be carcinogenic, mutagenic or reprotoxic for man. There is sufficient evidence that the substance is toxic for man, normally based on epidemiological data.
Category 2 is used when the substances should be regarded as if they are carcinogenic, mutagenic reprotoxic in man. There is sufficient evidence of toxicity in more than one other species.
Category 3 is used when substances cause concern for man, as to possible carcinogenic, mutagenic or reprotoxic effects. Normally there is evidence of toxicity in one species, and results are variable.
3.2.1 Carcinogenic and Mutagenic substances
Carcinogenicity and Mutagenicity are two health effects, which are strongly related to each other. A mutation is a change in the genotype of a cell, which is passed on when the cell divides. Chemical agents cause mutations by covalent modification of DNA. Certain kinds of mutations result in carcinogenesis, when the affected DNA sequence codes for a protein that is involved in growth regulation.
Special comments for carcinogenic substances;
The placing of a substance in category 1 is done on the basis of epidemiological data; placing into categories 2 and 3 is based primarily on animal experiments. Substances from category 3 may have been sufficiently tested, and were found to cause insufficient tumor-inducing effects, or they may have been insufficiently tested, creating the need for more testing where possible.
Sometimes it is not very clear whether a substance should be classified as category 2 or 3. For example when a substance is only carcinogenic at doses exceeding the maximum tolerated dose, or when a substance is carcinogenic in one species only.
Special comments for mutagenic substances;
A mutation is a permanent change in the amount or structure of the genetic material of an organism, resulting in a change of the phenotypic characteristics of the organism. A mutagen is an agent that gives rise to an enhanced occurrence of mutations. Induction of genetically relevant events in somatic cells is generally also regarded as an alert for possible carcinogenic activity.
Until present, 28th ATP has been published and 29th ATP is in progress, no substances are classified as mutagenic of category 1, illustrating the difficulty to obtain reliable information from studies.
Mutagenic substances in category 2 have shown to be mutagenic in vivo for germ cells of mammals, for somatic cells of mammals or to be mutagenic in general.
For placement in category 2, the following methods are appropriate:
For placement in category 3, also in vitro methods are accepted to support in vivo somatic cell mutagenicity assays or in vivo somatic cell DNA interaction assays. Substances showing positive results only in one or more in vitro tests should not be classified. Further testing in vivo is recommended for these compounds.
Reprotoxic substances can be toxic to the development of the unborn child or can cause impairment of fertility in male and female subjects.
Special comments for reprotoxic substances
Reprotoxic substances are divided into 2 groups;
1) Fertility;
The placing in category 1 is done on the basis of epidemiological data. Placing in categories 2 and 3 is done primarily on the basis of animal data. Data from in vitro studies are regarded as supportive evidence.
When effects have been demonstrated only in high doses, classification in category 3 or even no classification will be warranted. Also when studies are performed in only 1 species, without other relevant supporting evidence, classification in category 3 may be appropriate.
2) Developmental toxicity;
For classification in category 2 there should be clear evidence of adverse effects in more species. The route of exposure is also important.
Classification in category 3 or no category would be assigned when the only effects recorded are small changes in the incidences of spontaneous defects or small differences in postnatal developmental assessments.
Compounds which cause concern due to their effects on lactation should be labelled with R64, May cause harm to breastfed babies.
Sensitising substances are not divided into categories 1, 2 or 3. Sensitisers may have different impact, depending on the place of contact. Therefore they are divided as sensitisers by
- inhalation
- skin contact
Furthermore also Immunological contact urticaria is also a sign of sensitisation. Therefore that is the third form of sensitisation.

Substances, which are sensitising will be assigned the symbol ‘Xn’, the indication of danger ‘Harmful’ and the risk phrase R42.
R42 is assigned;
Hypersensitivity with humans is normally seen as asthma, but other hypersensitivity reactions such as rhinitis and alveolitis are also considered. The condition will have the clinical character of an allergic reaction. However, immunological mechanisms do not have to be demonstrated. Clinical history and data from appropriate lung function tests related to exposure to the substance may be confirmed by other supportive evidence such as;
Data from tests which may be indicative of the potential of a substance or preparation to cause sensitisation by inhalation in humans may include; IgE measurements or specific pulmonary responses in guinea pigs.
Substances and preparations shall be classified as sensitising and assigned the symbol ‘Xi’, the indication of danger ‘Irritant’ and the risk phrase R43.
R43 is appointed;
For the classification with R43, the following evidence is sufficient to classify a substance or preparation;
Following is sufficient to classify a substance with R43 when there is supportive evidence;

Immunological contact urticaria
For substances or preparations, which produce signs of immunological contact urticaria which do not fulfil the criteria for R42, consideration should be given to classification with R43.
There is no animal test available for testing for urticaria. Therefore, classification will be based on human evidence.
4 An introduction to the future; The Global Harmonised System
For the development of a global harmonised system for classification and labelling, the Organisation for Economic Co-operation and Development (OECD) is the focal point for developing criteria for human health and environmental hazards.
The work on harmonisation of hazard classification and labelling, focuses on a harmonised system for all chemicals and mixtures of chemicals. One of the objectives of the system is to make it so transparent that self-classification is better possible.
4.1 Criteria for classification and labelling, according to the global harmonised system
The Global Harmonised System (GHS) for C & L will not be very different from the C & L according to directive 67/548/EC.
The major change concerning CMR substances is that in the GHS no difference is made between categories 1 and 2, so there will only be 2 categories;
Category 1; Known or presumed human carcinogens, mutagens or reprotoxicants.
Category 2; Suspected human carcinogens, mutagens or reprotoxicants.
This new system will most probably be brought into force in Europe and will replace the current legislation on classification and labelling in the relatively near future.
Annex I of Directive 67/548 was updated for the 28th time in August 2001. An extract of Annex I was made, to identify all substances that are carcinogenic, mutagenic, reprotoxic or sensitising. This was done to create an overview of substances with such hazards.
Substances are divided by risk phrase and can be found in the tables below.
